2025年9月12日，第十四屆全國人民代表大會常務(wù)委員會第十七次會議通過《中華人民共和國突發(fā)公共衛(wèi)生事件應(yīng)對法》。

The law on public health emergency response was adopted at the 17th session of the Standing Committee of the 14th National People's Congress on September 12, 2025.

【知識點】

突發(fā)公共衛(wèi)生事件，是指突然發(fā)生，造成或者可能造成公眾生命安全和身體健康嚴(yán)重?fù)p害，需要采取應(yīng)急處置措施予以應(yīng)對的重大傳染病疫情、群體性不明原因疾病、群體性中毒以及其他嚴(yán)重影響公眾生命安全和身體健康的事件。為了預(yù)防和減少突發(fā)公共衛(wèi)生事件的發(fā)生，控制、減輕和消除突發(fā)公共衛(wèi)生事件的危害，提高突發(fā)公共衛(wèi)生事件應(yīng)對能力，規(guī)范突發(fā)公共衛(wèi)生事件應(yīng)對活動，保障公眾生命安全和身體健康，維護(hù)國家安全、公共安全和社會秩序，2025年9月我國發(fā)布了《中華人民共和國突發(fā)公共衛(wèi)生事件應(yīng)對法》。該法自2025年11月1日起施行。

根據(jù)該法，突發(fā)公共衛(wèi)生事件發(fā)生后，發(fā)生地縣級人民政府應(yīng)當(dāng)立即開展應(yīng)對工作，同時向上一級人民政府報告，必要時可以越級上報。突發(fā)公共衛(wèi)生事件發(fā)生地縣級人民政府不能消除或者不能有效控制突發(fā)公共衛(wèi)生事件危害的，上級人民政府應(yīng)當(dāng)及時采取支持措施，必要時統(tǒng)一領(lǐng)導(dǎo)應(yīng)對工作。

該法規(guī)定，縣級以上地方人民政府應(yīng)當(dāng)將突發(fā)公共衛(wèi)生事件臨時應(yīng)急處置場所建設(shè)納入國土空間規(guī)劃等相關(guān)規(guī)劃，依法推進(jìn)公共設(shè)施平急兩用改造。縣級以上人民政府衛(wèi)生健康主管部門、疾病預(yù)防控制部門、中醫(yī)藥管理部門應(yīng)當(dāng)加強(qiáng)衛(wèi)生應(yīng)急隊伍建設(shè)，定期組織開展演練。國家建立健全突發(fā)公共衛(wèi)生事件報告制度，醫(yī)療衛(wèi)生機(jī)構(gòu)及其執(zhí)行職務(wù)的人員發(fā)現(xiàn)突發(fā)公共衛(wèi)生事件報告規(guī)范規(guī)定應(yīng)當(dāng)報告的有關(guān)情形，以及發(fā)現(xiàn)發(fā)生或者可能發(fā)生突發(fā)公共衛(wèi)生事件時，應(yīng)當(dāng)于兩小時內(nèi)通過網(wǎng)絡(luò)直報系統(tǒng)進(jìn)行報告。對突發(fā)公共衛(wèi)生事件發(fā)生期間哄抬價格、牟取暴利、制假售假等擾亂市場秩序的行為，依法從重給予行政處罰。突發(fā)公共衛(wèi)生事件應(yīng)對結(jié)束后，應(yīng)當(dāng)及時刪除為應(yīng)對突發(fā)公共衛(wèi)生事件所處理的個人信息。
